CHENNEMPALLI - MY VILLAGE

           My village name is Chennempalli , which comes under Owk mandal of Kurnool district ,Andhra Pradesh. This village is 6kms away from Owk and 98kms from kurnool and 310kms from the capital of Andhra Pradesh. My village comes under Banaganapalle constituency .  In my village there are many temples .  Anjanayaswami temple which stands at the entrance of the village welcoming the people , there is lord Shiva temple at the center of the village , there is a saviti nearthe shiva temple , matam iis situated at the end of the village , nagulakatta is also there , church is also situated , masid is also there and there are some other temples in the village which i cannot remember. There is a primary school and high school in our village. Our village also has one paala kendram. There is also a post office in our village. There are so many wells sourounding our village which is the primary source for irrigation. All kinds of crops are been cultivated in our village.

ALTERNATE DISPUTE RESOLUTION

There are two methods of resolving a dispute. Firstly adjudication and secondly non - adjudication. This process may be with the help of a third party . The adjudication is further divided into judicial dispute resolution and arbitration. In these kind of process both the disputing parties agree to bind themselves to the third party decission i.e. court of law in case of judicial dispute resolution and arbitrator in case of arbitration. In case of non - adjudication process it is further divided into two methods i.e. negotiation and conciliation or mediation.
In the above said methods resolution of dispute through the court of law is known as judicial dispute resolution and other methods  i.e. arbitration , conciliation and negotiation are alternate dispute resolution.
ADR in India is the old method which was in existence even prior to arbitration act 1940.The arbitration and conciliation Act 1996 has adopted from UNCITRAL model.the Indian legal system has introduced sec 89 and sec89(1) by amending the CPC for settlements outside the court. Due to the slow running of the judicial system in India  there is a lot of burden on the ADR.
 Lok Adalat or known as people's court .In India disputes and litigation on any issues shall been decided by the elders of the villages.This Lok Adalats follows the Ghandian principles.This Lok Adalats are runned for settlements of disputes through conciliation.Every Lok Adalat is a civil court.
There should be a valid agreement inorder to start the arbitration process between the parties before coming across a dispute.The agreement should be in the form of writing as per sec 7 of the Act.The contract between parties must contrain arbitral clause or seperate documents of arbitral agreement.The party can appoint an arbitrator with concern of the other party orelse they can approach chief justice for appoint of an arbitrator.The appointed arbitrator must not be partial on any side and he should be enough qualified to act as an arbitrator.The arbitral tribunal has jurisdiction on its own jurisdiction. The party has to file appeal before the very same tribunal itself but section 34 of the Act provides speacial provissions to appeal before the principal civil court of original jurisdiction. Conciliation is simple than Arbitration.Any party can ask the other party to appoint a conciliator. But if a party does not want a conciliator then there is no question of conciliation.

IF SO THEN


will his party name would attract the people of andhra pradesh especially his father's fans and his followers ?. 
would it bring a dramatical changes in state politics? 
what would be his party's flag design?
 will his party's manifesto includes his father's aims?
 will his party seats will be alloted to new faces in the state politics ? 
will his 6 years experience in his father's political campaign would be enough to form a government in his first attempt ?
If his party wins then what would be his first signature as a CM ?
will his party attract the other party leaders in the state ?
 will he able to bring by-elections in the state?
would his party allot seats to the second grade leader?
will he able to maintain his popularity until the 2014 elections if he fails to bring by-elections?
will he start the Rachabanda programe which his father could not start?
will his party be able to withstand the competition with other major parties?






                                        One thing we can do is JUST WAIT AND SEE.....

BLACK DAY ,DEC 6th.

        December 6th is known as black day in INDIA , on december 6, 1992 Babri Masid has been demolished in Ayodhya by hindu community as there was a temple of lord rama before the mosque was built.. At that point of time the  whole India was schocked , especially muslim community has become shock with this incident. 
      
      Recently on 30th september , a three judges bench of Allahabad High Court has passed an order that the disputed land measuring 90 feet by 120 feet where babri masid once stood into three parts one to ram lala diety , one to nirmohi akhara , one to sunni wakf board. But this judgement has not satisfied by the communities has filed their appeals before the Supreme Court of India.

High Court follows certain procedure in its daily work. The high Court works from monday to friday.The Timings are from 10:30 A.M. to 4:15 P.M.with a lunch break at 1:30 P.M. to 2:15P.M. There are 49 courts in the High Court of AP.The judges takes their seats in court halls sharp 10:30 A.M , any urgent matters and adjournments may be mentioned at this time and may request for lunch motion which would called for hearing at 2:15 P.M.,The court master would call each case and if we want know about the case which was called at your absence in the court you can en quire about the same with the court master or you can ask the attender about the case.  At 1:30P.M. the advocates can mention for adjournments even at the time when the judges are getting down for lunch break with their kind permission i.e at 1:30P.M. and also at the time they are taking seat after lunch i.e at 2:15 P.M. and again at the time the judges get down i.e at 4:15P.M. for adjournments of the cases which are not reached. The judges take up the motion list at 10:30A.M and daily list continues. Motion List includes the fresh admission matters which are been filed the day before. The fresh CRP cases are been distributed among the judges basing on the district wise and the WP cases are distributed as per the allotment to th judges.  From monday to wednesday the admission cases of WPs and CRPs take place and on thursday and friday the final hearing cases are to be heard and on friday  the portfolio cases are also listed. Bails shall be taken up on every day i.e monday to friday. In Criminal cases they are alloted to judges by type of criminal cases like criminal petitions (bails and quash) , criminal revision cases , criminal appeals. The civil appeal cases like S.A and A.S shall also be alloted to the judges. CCCA shall be alloted. The W.A and PIL cases shall be alloted to the Chief Court (1st court). There also be matters which would be decided by the division bench consists of more than one judge. There also be matters which would be decided by Full Bench which consists of more than two judges. There also be C.C cases taken up by the judges.There are also MACMAs , CMAs , ARBAPPL , TRCMP , FCA .cases.
